The Regulatory Tide Is Turning

Enterprise blockchain adoption has accelerated faster than the regulatory frameworks designed to govern it. In 2025, however, regulators in Brussels, Frankfurt and Warsaw are closing that gap with a flurry of binding instruments. Understanding each framework is no longer optional for compliance teams.

MiCA: The Cornerstone

The Markets in Crypto-Assets regulation (MiCA) entered full effect on 30 December 2024. It imposes mandatory authorization for crypto-asset service providers (CASPs) operating within the EU, standardized white-paper disclosure requirements, and strict governance rules for stablecoin issuers. Enterprises that have not mapped their token activities against MiCA risk significant fines under Article 111.

DORA and Blockchain Nodes

The Digital Operational Resilience Act (DORA) treats blockchain nodes operated by financial institutions as critical ICT assets. From January 2025, firms must conduct annual resilience tests against simulated attack scenarios, maintain 72-hour incident-reporting SLAs, and ensure their smart-contract vendors meet third-party risk management standards.

AML6 Integration

The sixth Anti-Money Laundering Directive explicitly covers decentralized finance protocols for the first time. VASPs must now implement Travel Rule data transmission for transactions above €1 000, including wallet-to-wallet transfers that pass through custodial intermediaries.

Practical Steps for Compliance Teams

Looking Ahead

The European Securities and Markets Authority (ESMA) is expected to finalize Level 2 technical standards for MiCA by mid-2025. Compliance Guard will publish annotated guidance as each instrument is released. Subscribe to our regulatory digest to stay ahead of deadlines.
